BRITISH CITIZENSHIP FOR ADULTS

All foreign nationals can apply for British Citizenship if,

• They have had Indefinite Leave to Remain (ILR) for 12 months

• They are married to or in a civil partnership with a British National

• They have lived lawfully in the UK for at least 3 years

• They hold an ILR (for any period)

Individuals applying for British Citizenship must also be of good character, i.e., they must have no unspent criminal convictions, and their absences must be within those allowed by Immigration rules.

An English Language and Life in the UK test is required, with applications requiring two referees. Successful applicants must also attend a citizenship ceremony.

BRITISH CITIZENSHIP FOR CHILDREN

A child (i.e., someone under the age of 18) can apply for registration as a British citizen in certain circumstances, for example:

If they were born in the UK and their parent(s) become British or settled after they were born.

If irrespective of their parents’ nationality or immigration status, they were born in the UK, lived in the UK until at least the age of 10, and spent no more than 90 days per year outside the UK during the first ten years of their life.

However, registration of children as British citizens is more flexible than naturalisation or registration for adults, and the Home Office exercises discretion about this.

Any child living in the UK, even if they were not born in the UK, can apply for registration as a British citizen on a discretionary basis. If their parent(s) are British or settled in the UK, and the child’s future is likely to be in the UK, the application may succeed. Moreover, with an older child, the longer they have lived in the UK, the stronger the application is likely to be.There is no English language or citizenship ceremony for children, but two referees must endorse the application.
