EEA NATIONALS AND NON-EEA FAMILY MEMBERS

EEA and Swiss nationals are allowed to live and work in the UK without requiring a separate work permission (known as a right of residence).

Only a ‘qualified person’ is allowed to stay in the UK for more than three months.


You could be qualified on the basis of studies, employment (including jobseekers) or economic self-sufficiency. You can apply for a registration certificate which confirms this.

Direct or extended family members of non-EEA nationals can also apply to remain or join you in the UK. Your direct family members include your spouse or civil partner, children under 21 years, and any dependant parent or grandparent.

Extended family members are required to have a valid EEA family permit or residence card. Your extended family members include an unmarried partner or any other dependant relative. Dependant relatives are required to prove their must ongoing dependency on you or a member of your family before you arrived in the UK, to date.

Alternatively, you can apply if that your family member seriously needs your personal care on serious health grounds.


A primary carer of someone who has the right to live UK (or the primary carer’s child) can apply for a ‘derivative residence card’. It might also be possible if you’re the child of an EEA national and currently in UK education.



You are required to provide original evidence such as your relationship with that family member, proof of identity and current status as a qualified person.

EXTENSION APPLICATIONS

An EEA family permit is only valid for six months initially when applied from outside the UK. This can be extended into a residence card for a further 5 years.

PERMANENT RESIDENCE

You can apply for Permanent Residence if you stay in the UK for a continuous 5-year period in this category as an EEA national or family member.
